Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that on or about October 15,
1989 employees responding to an emergency ammonia leak in the compressor
room were exposed to the hazards of toxicity, fire and/or explosion, and
atmospheres immediately dangerous to life and health due to the lack of
an effective emergency shut-down procedure and a safety located stop
valve operable form outside of the compressor room.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to:
1) Develop and implement an emergency safe shutdown procedure which
details necessary step-by-step actions to be taken by employees who
are tasked with the duty of responding to, and controlling releases
of ammonia refrigerant which requires a safe location for the
shutdown of the refrigeration system.
2) Provide necessary and periodic review of the emergency shutdown
procedure by a qualified person to ensure the adequacy of the
procedure and the safety of the employees responsible for controlling
inadvertant and hazardous releases of ammonia refrigerant.
