Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Operators of the loaders and backhoe, were exposed to the hazard of being thrown from the vehicle and being struck by the truck, or overhead guard in the event of a tip over. Among other methods, one feasible and acceptable method to correct this hazard would be to require the use of the seat belt system that was installed on the trucks, as required by the Society of Automotive Engineers and manufacturer recommendations.o/ J y y J p\
