Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls while accessing and performing work on a telecommunication tower in that: a)On or about March 22, 2000, and prior to that date, employees were transported to elevated work locations by use of a personnel basket and a trial lift with the unoccupied personnel platform loaded at least to the anticipated lift weight, from ground level, or any other location where employees will enter the platform to each location at which the personnel platform is to be hoisted and positioned. This trial lift was not performed immediately prior to placing personnel on the platform in that the hoist operator did not determine that all systems, controls and safety devices are activated and functioning properly; that no interferences exist; and that all configurations necessary to reach those work locations will would allow the operator to remain under the 50 percent limit of the hoist's rated capacity. b)On or about March 22, 2000, and prior to that date, employees were transported to elevated work locations by use of a personnel basket operated from a base mounted drum hoist without a pre-lift meeting conducted/attended by the hoist operator, signal person(s), employee(s) to be lifted, and the person responsible for the task to be performed to review the appropriate requirements for lifting personnel and the procedures to be followed; prior to the trial lift. One means of abatement among others, is to: a)Assure safe work practices identified in CPL 2-1.29, Interim Inspection Procedures During Communication Tower Construction Activities, 01/15/1999, are complied with at all times; (1)Conduct a pre-lift meeting attended by the hoist operator, signal person(s), and employees to be lifted; (2)Conduct a trial lift prior to lifting personnel to determine all systems controls and safety devices are functioning properly.ng
