Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being crushed or struck by loads such as machinery due to
the overloading of
the equipment and improper storage of slings, in that:
a) Three of the five C.M. Model "B" Pullers located in the maintenance
shop for the Carbonless
department used to position (averaging 2000 pounds) motors in place were
not marked as to the
load capacity, controls to indicate function or direction of motion, name
of manufacturer,
manufacturer model number, and serial number as required by ANSI
B30.21-1999, for manually
lever operated hoist (chain type).
b) One of the five C.M. Model "B" Puller that had the lock and the lifting
device altered to
position motors in place was not authorized by the original equipment
manufacturer
or by a
qualified person as required by ANSI B30.21-1999 for manually lever
operated hoist chain type.
c) The five manually lever operated hoists were not being inspected
frequently or periodically
as required by ANSI B30.21-1999 for manually lever operated hoist (chain
type).
A feasible and acceptable method of abating these conditions would be to
insure all manually
lever operated hoists are properly marked, load test, inspected, certify
and properly stored in
accordance with the ANSI B30.21-1999 for Manually Lever Operated Hoists.
