Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The employer failed to protect employees while they worked in a trench installing an irrigation line, in that the excavation was sloped at an angle deeper than 1 1/2 horizontal to 1 vertical, there was no ladder or other safe means of egress out of the trench excavation and there was no daily inspection of the trench excavation by a competent person. FEASIBLE ABATEMENT METHODS INCLUDE, BUT ARE NOT LIMITED TO: 1)Provide a ladder, stairway, ramp or other safe means of egress in trench excavations of greater than 4' in depth, so as to require no more than 25' of lateral travel for employees. 2)Ensure daily inspections of the excavation, the adjacent areas and protective systems by a competent person for evidence of a situation that could result in possible caveins, indications of failure of protective systems, hazardous atmospheres or other hazardous conditions. 3)Protect each employee in an excavation from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).

FEASIBLE ABATEMENT METHODS INCLUDE, BUT ARE NOT LIMITED TO: 1)Provide employees hard hats where they work in excavations exceeding 5' in depth or where there are overhead hazards.
