Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by an unsecured wheeled cot and collision
with objects in the rear
area of a passenger van while accompanying injured personnel to a medical
clinic:
Security Officers were exposed to being struck by an unsecured wheeled cot
and collision with
other objects in the van while sitting or kneeling on the floor or on a
unsecured box in the rear
area of the van during transport of injured personnel from Plants 1, 3 &
the New Paint house.
Methods of abatement of this hazard include but are not limited to:
a.Provision of a properly equipped seat for the safe passage of the
Security Officer
during the transport of injured personnel and,
b.Provision and use of a mechanical locking device for firm securing of the
wheeled cot during transport of injured personnel; or,
c.Elimination of the use of the wheeled cots for transporting injured
personnel;
d.Prohibition of Security Officers from riding in the back of the
passenger vans
unless in a properly equipped and secured seat;
The gravity based penalty for the above alleged violation was $2000.  The
proposed
penalty reflects consideration, where appropriate, for the employer's good
faith, size of
business and history of previous violations.
