Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious phusical harm to employees in that employees were exposed to:
The following conditions which increase the risk of employees
contracting bloodborne diseases:
a) Health care workers such as nurses and technicians in areas such ass
the Emergency Department, the Operating Rooms, the Morgue, the
the Histology - Pathology Department, Hemodialysis, Cardiac
Catheterization, Labor and Deliver, Departments involved in the
pick-up and transport of blood-contaminated laundry and waste, and
the intensive Care Units were exposed to the hazard of being infected
by the hepatitis B Virus (HBV) through possible direct contact with
blood or other body fluids.
Feasible and useful abatement methods for reducing this hazard, among
others, are the offering of Hepatitis B Vaccinations to all employees
who are involved in the performance of invasive procedures, in the
handling of hemorrhaging patients, or who perform activities which
present a potential for employee contact with patient blood or other
potentially infectious fluids. The Hepatitis B Vaccinations must be
offered before, not merely after, an exposure incident such as an
accidental skin puncture by a contaminated sharp object has occurred.
b) Health care workers such as nurses and technicians in the Emergency
Department were exposed to the hazard of being infected by the
Hepatitis B Virus (HBV) and/or Human Immunodeficiency Virus (HIV)
through possible direct contact with blood or other body fluids.
Feasible and useful abatement methods for reducing this hazard, among
others, are the provision of training concerning the matters listed
below to all instead of only 86.5% (ie 32 out of 37) of the employees
working in the Emergency Department:
1) The modes of transmissions of the HIV (Human immunodeficiency virus)
and the HBV (Hepatitis B virus).
2) The universal precautions concept.
3) The proper procedures which must be followed to safely containerize
and label refuse and launderable fabric items which have become
contaminated with patient blood or other potentially infectious body
fluids.
4) The epidemiology of HBV and HIV.
5) Possible risks to a fetus.
6) The proper procedures which must be followed in regard to the wearing
and care of personal protective clothing and equipment.
7) The contents of CDC's "Update: Precautions For Prevention of
Transmission of HIV, HBV and Other Bloodborne Pathogens in Health
Care Settings".
