Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) The hazard of being struck by, mauled or bitten by bears
in that there were not adequate procedures and training on the safe
feeding and transferring of bears. One feasible and useful method
of abatement is the development of and training on safe procedures
and/or shields, barriers, etc., for feeding and transferring of bears
which eliminates employee exposure to the bears with routine
monitoring and enforcement of the procedures.
