Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were posed to: a) Employees were exposed to the hazard of being struck by amusement park rides in that employees had not received training and instruction in the recognition and avoidance of unsafe conditions and the precautions necessary in order to control or eliminate exposure to hazardous conditions. All employees who were authorized to operate rides had not received training which included, among other things, but how to turn rides on and off, the location and function of emergency stop controls, the prohibition not to attempted to discharge passengers while a ride was in motion, and not to attempt to manually stop moving cars (such as on the "serpent" ride). Among others methods, one feasible and acceptable method to cor- rect this hazard is to provide more extensive training and instr uction for all ride operators which includes the recognition and avoidance of unsafe conditions. Such training must ensure that employees are familiar with and fully understand all applicable safety instructions including those outlined in the "operator Handbook" issued by the Ohio Department of Agriculture, Amuse- ment Park safety Division.
