SECTION 5(A)(1)OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970: THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO: A) ON OR ABOUT SEPTEMBER 20, 1990, EMPLOYEE(S) WERE EXPOSED TO THE HAZARDS OF FALLS FROM THE RUSSELL-IRONTON BRIDGE SHOULD THE WIRE ROPES BREAK WHILE WORKING FROM EITHER OF THE TWO SCAFFOLD PLATFORMS, EACH SET UP WITH AN END SITTING ON AN INDIVIDUAL WIRE ROPE CABLE, STRETCHED BETWEEN AND WRAPPED AROUND THE BRIDGE SUPPORT WITHOUT PROTECTING THE WIRE ROPE FROM CRUSHING OR ABRASION. AMONG OTHER METHODS ONE FEASIBLE AND ONEACCEPTABLE ABATEMENT METHOD TO CORRECT THE HAZARD IS TO INSERT A PROTECTIVE MEMBER BETWEEN THE BRIDGE SUPPORT(S) AND THE WIRE ROPE.
