Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) Personnel were exposed to the hazard of being struck by a suddenly
shifting or falling load when boats weighing several thousand pounds
were hoisted and suspended by load lines attached to the boats bow
eyes which were not intended for lifting purposes by the boat
manufacturer nor recognized by the American Boat and Yacht Council.
Abatement of the hazard can be accomplished by:
1) The use of lift eyes which are fittings designed for lifting a
vessel; or
2) The use of web slings rigged in a basket hitch under the boat hull;
or
3) The use of other abatement devices explicitly approved by the boat
manufacturer and recognized safe by the boat manufacturing industry.
