Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Personnel were exposed to the hazard of falling and being struck by a Caterpillar grader operated on 1st Avenue between Lake Street and Chicago Avenue in Maywood, Illinois. The grader was used as a mode of transportation by personnel standing atop the grader blade as the equipment was in motion. Abatement of the hazard can be accomplished by: 1) The immediate removal of personnel riding on equipment except for training purposes, and then only when a seat is provided. 2) The reemphasis to personnel of the current Palumbo Brothers, Incoporated safety policy which prohibits the transportationof passengers on construction equipment. 3) The initiation of disciplinary action against personnel violating company safety rules.
