Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) Personnel were exposed to the hazard of falling and being
struck by a Ford front end loader operated on the Riverway
Project Property, Rosemont, Illinois. The bucket of the loader
was used to transport personnel and materials on the job site.
Abatement of this hazard can be accomplished by:
1) The immediate removal of personnel riding on equipment except
for training purposes, and then only when a seat is provided.
2) The reemphasis to personnel of the current Landscape
Contractors of Illinois, Incorporated safety policy which
prohibits the transportation of passengers on construction
equipment.
3) The initiation of disciplinary action against personnel
violating company safety rules.
