Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: ... the hazard of asphyxiation, illness, fire and explosion. The employer did not provide employees entering railroad tank cars, reactors, and tanks an adequate confined space entry procedure to protect employees from possible exposure to toxic substances, combustible gases and oxygen deficient atmosphere while performing inspection, maintenance, repairs and clean up. A feasible and acceptable abatement method, among others, to correct this hazard, is to implement a formal confined space entry procedure in accordance with ANSI Z117.1-1977 which includes but is not limited to, the following elements: 1) A written program explaining the use of permit entry system, ventilation, atmospheric testing, rescue procedure, employee training and which designates a responsible official responsible for the program's implementation. 2) Implement the use and the posting of a confined space entry permit system which provides authorization to enter a confined space, specifies the type of work to be done, certifies that all existing and potential hazards have been evaluated by a qualified person and specifies that necessary protective measures to be taken to ensure the safety of each person. 3) Provide for the use of mechanical ventilation of the confined space to be entered prior to entry and continued ventilation to provide for a safe atmosphere when determined necessary as described in (2) above. 4) Provide for the testing of the confined space atmosphere prior to entry ans on a regular basis for the presence of sufficient oxygen (19.5%) and the absence of hazardous levels of toxic or combustible gases or vapors as determined necessary in (2) above. 5) Establish an emergency rescue procedure with a requirement that trained personnel are available and stationed outside the confined space with proper equipment to provide for an effective rescue of persons entering the confined space. Such rescue equipment must include safety harness and lifeline with provisions for hoisting employees from the confined space. If entry is required for rescue, the rescuing employee must be equipped with approved air supplied respiratory equipment and other appropriate protective equipment. 6) Provide for the training of any and all employees that may be required to enter a confined space. The training shall include the procedures of the confined space program and the hazards associated with working in confined spaces.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment an a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: ...increased hazard of explosion caused by water accumulated in the vent line for the rupture disc from the nitrogen pressurized blow tank. Both the weight of the water and vigorous reaction of Thionyl Chloride with water would contribute to produce a back pressure which would impede discharge of the tank contents should the rupture disc be blown. Section UG-135 (g) of the 1989 Edition of the ASME Boiler and Pressure Vessel Code, Section VIII Division 1, requires discharge piping to be fitted with an open drain to prevent liquid from lodging in the discharge side of the safety device. Among other methods, one feasible and acceptable abatement method to correct this hazard is to fit the discharge pipe for the rupture disc with an open drain.
