Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
...Hazards of being struck by falling portions of loads and/or portions
of hoisting equipment due to failure of the tower erection boom in use
on the microwave relay tower jobsite located at the new Illinois State
Police Post east of Ullin, Il during hoisting operations.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to perform the following:
A comprehensive visual examination of the tower erection boom on a
periodic basis determined by the employer for such defects as rusting,
cracked welds, and bent/deformed/broken boom members;
A visual inspection of the boom in a tower under construction;
prooftests of the tower erection boom and its associated rigging,
fittings, and hoist rope to 200% of the rated load (utilizing either
a free-swinging weight or other equivalent means such as the use of
an adequate anchorage combined with a dynamometer) when the boom is
first erected on a tower site and prior to any subsequent lifts after
the boom is "jumped" within the tower structure; and
a visual inspection (using binoculars if necessary) by the equipment
operator at the start of each work shift to assure that all load
bearing means, running gear and the hoist clutch and brakes are
operating in accordance with the manufacturer's specifications.
