Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which was free
from recognized hazards that had caused or could have caused death or
serious physical harm
to his employees:
a) On or about 1/28/94 and 2/4/94 Halverson  Midwest Joint Venture had
employees
pouring concrete, working from man lifts, and working from steel beams at
heights ranging
from approximately 18'-0" to 25'-0" without using fall protection such as
safety harness,
shock absorbing lanyards, and life lines.
b) On or about 1/28/94 and 2/4/94 Halverson Midwest Joint Venture allowed
the
employees of P.S. Deppe Construction, their subcontractor for steel
erection, to set steel and
bolt up steel without using safety harness, shock absorbing lanyards, life
lines or other means
of fall protection.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to require the use of full body harness and shock absorbing lanyards
attached to safety
lines or static lines.
