Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which was free from recognized hazards that had caused or could have caused death or serious physical harm to his employees: On or about 1/28/94 the employer, a subcontractor for steel erection, set steel and bolted up steel on a bridge without using safety harness, shock absorbing lanyards, life lines or other means of fall protection exposing workers to falls from heights up to approximately 25'-0". Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the use of full body harness and shock absorbing lanyards attached to safety lines or static lines. The employer is responsible for selecting and carrying out an appropriate abatement method.
