Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
being struck by a 55 gallon drum of paint:
Employee hoists the drum of paint above his head to position it over
paint mixer vats and remains under the drum to open the valve and
empty the paint into the vat. The drum of paint is lifted by anair
powered chain hoist.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to elevate the employees work level to a height
where he would not be working under the drum. ANSI standard B30.16-1973
"Overhead hoists" section 16-1.3.2.3.(f) states that "the operator
shall avoid carrying loads over people."
