Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: ...the hazard of death due to crushing injuries in that the Caterpillar Scraper 623B had no brakes ans was stopped by dropping the pan, and the Caterpillar Compactor 816B had back brakes but no front brakes due to a broken brake line. Both vehicles were used on the landfill on a slope at Macon County Landfill Inc., Decatur, Il. One feasible and acceptable abatement method to correct this hazard is to repair the brakes of both vehicles and to ensure that general maintenance checks said brakes on a regular basis.
