SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970: THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO: EMPLOYEES WERE EXPOSED TO THE HAZARD OF BEING STRUCK BY THE UNDERSIDE OF FLOORS AND SUBSEQUENT FALLS AS THERE WERE NO CONE GUARDS ON THE MANLIFT LOCATED IN THE GRAIN ELEVATOR. IN ADDITION, IF POWER TO THE MANLIFT WAS CUT OFF, EMPLOYEES WERE EXPOSED TO FALLS WHILE TRYING TO ASCEND THE MANLIFT STRUCTURE, AS THERE WAS NO EMERGENCY LADDER. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO INSTALL UNDERFLOOR HOODS (CONE GUARDS) AND AN EMERGENCY LADDER TO THE MANLIFT IN ACCORDANCE WITH ANSI A.90.1-1985.
