Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: A potential fall of 14 stories in that on or about May 11, 1991, the employee utilized a My-Te winch-hoist model 100 A HC material hoist to lower an employee into an exhaust duct from the roof of the Pere Marquette Hotel, Peoria, IL. Neither the hoist, hook, spr- eader/lanyard attachment nor suspension system was approved, tested , or designed for lifting personnel, and was subject to possible failure and becoming disconnected thus causing falls. Among other methods, one feasible and acceptable abatement method to correct this hazard is to utilize a boatswain's chair properly attached to an approved hoisting device as specified in 29 CFR 1910.28(i) or 1910.28(j).
