Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
The hazards of bursting or failing components caused by an unapproved
pressure vessel on February 16,1989, at the old firs unit off press
#3, in the west press room. The pressure vessel was not marked or
certified under the requiremetn of the ASME (American Society of
Mechanical Engineers) Boiler and Pressure Code, Section VIII, Rules
for Construction of Pressure Vessels, Division 1. For example:
a) The pressre vessel as not constructed in accordance with the rules
of Division 1, as required under paragraph U-1(f) of that code;
b) The user did not establish specific design requirements for the
pressure vessel, taking into consideration factors associated with
normal operation, etc., as required under paragraph U-2(a) of that
code;
c) The pressure vessel did not pass a prescribed hydrostatic test, equal
to at least 1 1/2 times the maximum allowable working pressure, as
required under paragraph UG-99 of the code;
d) The pressure vessel was not provided with the marking required by
paragraph UG-116, which includes:
1) The official code symbol;
2) The manufacturer's name
3) The maximum allowable working pressure;
4) The manufacturer's serial number; and
5) The year of manufacture;
e) The pressure vessel was not provided with protection devices, safety
and relief valves or rupture discs, as required under paragraph
UG-125(a) of the code; and
f) The pressure indicating gage was not graudated to approximately
double the operating pressure, as required under paragraph UG-125(f)
of the code.
Among other methods, one feasible and acceptable method to correct these
hazards is to assure that the design, manufacture, certification, and
use of all pressure vessels is in accordance with the most current ASME
Boiler and Pressure Vessel Code.
