Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to:
(a) Employee(s) entered confined spaces, i.e. TL 47 Trainer,
diesel fuel tank of a ship for the purpose of sanding, cleaning
and spraying coats of epoxy spray. The spray contains polyamide
resin and n-butyl alcohol vapors, explosive employees to the po-
tential hazard of asphyxiation and explosive and/or toxic atmos-
pheres immediately dangerous to life of health.
A confined space entry procedure, specific for this operation
had not been implemented. The procedure shall include at least
the following:
(1) Written initial plan including, but not limited to, at-
mospheric testing, desigation of qualified people for
standby and emergency procedures, training or personnel
to include training of any and all employees required to
enter the confined space after the n-butyl alcohol and
polyamide resin mixture have been introduced into the
tank.
(2) Mechanical ventilation of the confined space prior to
the entry and continued ventilation to provide a safe
atmosphere.
(3) Testing the atmosphere of the confined space prior to
entry and on a regular basis for presence of sufficient
oxygen (19.5%) and absence of hazardous levels of toxic
or combustible gases or vapors.
(4) Emergency procedures with requirements that trained per-
sonnel are available and are stationed outside the con-
fined space with proper equipment to provide for the
rescue of persons entering the space. Such equipment
must include safety harness and lifelines with provi-
sions for hoisting employees from the confined space.
If entry is required for rescue, the rescuing employee-
(s) must be equipped with approved air supplied respira-
tory equipment and other appropriate personal protective
equipment.
(5) Training of any and all employees required to enter the
confined space after toxic compounds have been intor-
duced into the space. This training shall include pro-
cedures required prior to entry and the hazard associat-
ed with work in the confined spaces.
