Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On 12/19/94, at the flyash common silo, the knife gate valve located in the piping system (which contained over 200 tons of flyash) was not closed and locked or tagged out prior to employees removing an expansion flange located downstream of this valve. A feasible method of abatement that could be used to correct this hazard is: In the piping system, lockout or tagout the knife gate valve in the closed position to prevent premature or accidental opening of the valve.g
