Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not ensure that the work site was free from recognized hazards, in that, an adequate Falling Object Protection System (FOPS) was not in use on the Ford 4400 series tractor that was used to elevate the conveyor system into place at the job site. One feasible means of abatement would be to: Equip the Ford tractor with an adequate protective device designed to protect the operator from falling objects.
