Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
a.  For employees who weld and enter confined spaces, the
employer did not have a confined space entry program that provided
minimum safety requirements to be followed while entering, exiting
and working in confined spaces in that:
On April 11, 1992, two employees were working on a gasoline
tanker and preparing for and initially entering the tanker to weld.
Employees were exposed to a potential oxygen deficient atmosphere
and inhalation hazard from petroleum distillates.
No initial monitoring was performed to determine if oxygen levels
were safe and if levels of vapors were safe for employee
exposure.  Explosive levels were read by the employees.
Compressed air in the airline breathing system was not tested
to be assured that it met Grade D breathing air requirement.
The life lines and belt used by the employee entering that tank
were substandard in that the employee was using a plain webbed
belt (no harness) and the lifeline was a frayed cotton rope.
Harness did not meet ANSI Standard A-10-14-1975.  The standby
man had no SCBA man by nor was there one on site and there were
no other means for an emergency rescue to be performed.
A written confined space program shall contain the following
elements:
1.  Personnel who enter confined space shall have a
preplacement physical exam which demonstrates personnel's
ability to be in a confined space and the ability to use
a negative/positive respirator.
2.  Personnel (including stand-by personnel) who work in
and around the confined space shall be made aware of the
hazards associated with confined space.  Personnel shall
have additional training in other areas which would include
but not be limited to:
a.  emergency entry and exit procedures,
b.  use of applicable respirators such as airline,
c.  lockout procedures,
d.  safety equipment use,
e.  rescue and training drills designed to maintain
personnel proficiency,
f.  a permit system,
g.  and work practices such as but not limited to purging
and ventilating of confined space, continuous general
ventilation maintained with in the confined space where
toxic atmosphere may be produced as part of the work
procedure, authorized procedures and processes for
cleaning inside of confined space, appropriate equipment
and tools for confined space and written records for
training including safety drilles, inspections, tests,
and maintenance with regards to confined space.
3.  Safety equipment necessary to protect workers in the confined
space environment such as safety belts with "D" rings for
attaching a lifeline shall be worn at all times.
4.  The employer shall maintain a written record of training
including safety drills, inspections, tests and maintenance.
The records shall be maintained one year after the last date
of training, inspection, test or maintenance.  In the event of
separation of the employee, disposal of equipment or appliance,
records may be disposed after one year.
Where atmospheric testing indicates the presence of a toxic
substance, records shall be maintained in accordance with the
existing Federal Regulations.  These records shall include the dates
and times of measurements, duties and location of the employees within
the confined space, sampling and analytical methods used, number,
duration, and results of the samples taken, PEL concentrations
estimated from these samples, type of PPE used, if any, and employees'
name.
