Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that on or about May 7 and May 8, 1991, employees worked stringing utility poles by riding and standing in and/or on the bucket of a Ford 545 front end loader exposing themselves to fall hazards of up to twelve (12) feet and to the hazard of being crushed between the loader bucket and fixed objects such as utility poles. Among other methods, feasible and acceptable abatement methods to correct this hazard include the safe usage of ladders or approved personnel lifting equipment designed to elevate personnelto job sites above ground such as, but not limited to, articulating and/or extensible boom platforms.
