Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the increased likelihood of fire, resulting in severe burns, from
improperly operated, inspected and maintained boilers. Specific
deficiencies noted at the time of the inspection included the following:
a) Boiler Room, Cleaver Brooks Boiler, Model #CB200-300, serial #1-7623
had a corroded motor drive for the gas valve. Boiler stack
temperature gauge was broken.
b) Operating instructions and maintenance procedures were not available
for, nor was regular maintenance being performed on the following
boilers:
1) Cleaver Brooks Boiler, model #CB200-300, serial #1-7623.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to establish an operating, inspection and
maintenance program for plant furnaces and boilers as stipulated in
National Fire Protection Association Standard No. 85A. Essential
elements of this program shall include, but not necessarily be limited
to, the following:
1) Repair and/or replace motor drive for gas valve and defective gauges
on boilers.
2) Establish a program for maintenance of equipment at intervals
consistent with type of equipment, service requirements and the
manufacturers' recommendations to assure it remains in proper working
order.
3) Provide written operating procedures and detailed checklists for
operator guidance, including all manual and automatic functions, in
the safe operation of boilers and furnaces. Train operators in the
use of these procedures and checklists.

to change a sump pump.
The employer did not have an established confined space entry
procedure requiring the training in confined space entry procedures,
testing and montoring of the atmosphere for the presence of
sufficient oxygen and the absence of hazardous levels of toxic or
combustible gases or vapors, and had not established a rescue
procedure.
Among other methods, one feasible method by which hazard may be
corrected:
1) Repair and/or replace motor drive for gas valve and defective gauge
on boiler.
2) Establish a program for maintenance of equipment at intervals
consistant with type of equipment, service requirements and the
manufacturers' recommendations to assure it remains in proper working

or serious physical harm to employees in that the hazard of being struck
by parts of shopmade hood devices which are not designed to withstand
the shock loading imposed upon them was not secured from displacement
during the waste removal (ragging) operation in pulpers number 1 and 2.
Among other methods, one feasible and acceptable abatement method to
reduce this hazard is to install a device that will continously collect
waste during the operating cycle, and install provisions for mechanical
removal by a power operated hoist. The removal system shall incorporate
the following additional provisions:
1) Design the removal system such that the operator(s) station is
located in a protected area in the event of a sudden release of
tension during the removal operations.
2) Train employees in the use of the removal system and ensure that they
understand how to operator the removal device and the potential
hazards involved in its operation.
Another feasible and acceptable abatement method reduce this hazard is
to have a professional engineer design an attachment to pull out waste
safely. The attachment shall incorporate the following additional
provisions.
1) Inspect the attachment daily for damage of defects by a competent
person.
2) The attachment shall be designed for four times the rated shock load
that is to be expected.
3) The attachment shall have a rated load test to 125% of its rated
capacity. The test report shall be maintained on file and available
to OSHA.
4) The attachment shall incorporate provisions to prevent accident
displacement during shock loading.
5) The rated capacity shall be marked and visible on the attachment.

necessary to comply with the standards set forth in 20 CFR 1910 as
evidence by the violations of Part 29 CFR 1910 noted during the
course of the inspection.
Among others, one feasible and useful means of abatement would be to
effectively incorporate the following elements into an accident
prevention program:
1) Develop a policy statement of management commitment and leadership
toward safety and health with goals established, issued and
communication to employees.
2) Develop employees' participation in safety meetings and inspections.
3) Ensure commitment of resources toward program is adequate.
4) Incorporate safety rules and procedures into site operations.
5) Ensure management observes safety rules.
6) Assign a safety designee on site that is knowledgeable and
accountable.
7) Ensure supervisors (including foreman) understand safety and health
responsibility.
8) Ensure employees adhere to safety rules.
9) Implement a periodic site safety inspection program that involves
supervisors.
10) Install preventive controls such as personal protective equipment,
maintenance and engineering controls.
11) Take action to address hazards.
12) Develop enforcement procedures by management.
13) Ensure supervisors receive basic training in identification and
control of hazards.
14) Develop an employee training program that is ongoing and effective.
15) Require supervisors to perform accident investigations, determine
cause, and propose correvtive action.
16) Evaluate injuries, near misses, and illnesses for trends,
17) Develop emergency procedures and training.
