Section 5(a)(1) of the Occupational Safety and Health Act of 1970:   The
employer did not furnish employment and a place of employment which was     f
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed to the
hazards of bloodborne disease without the Hepatitis B Vaccination:
(a)  The phlebotomists at the blood-drawing laboratory was exposed to
the hazard of being infected by bloodborne pathogens such as the Hepatitis
B Virus (HBV) through possible direct contact with blood or other           P
ly Infectious Materials (OPIM). Feasible abatement methods for reducing     t
hazard, among others, are the provision of a Hepatitis B Vaccination Pro-
gram, free of charge, to all employees who are at substantial risk of
directly contacting blood and OPIM.
