Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
Employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that:
(a)A 1 ton chain hoist was being used to pick up steel dies in the machine
area which
exposed the employees to being struck by falling or displaced loads.
Frequent and periodic
inspections were not being conducted on the hand operated chain hoist used
to lift dies in the
machine area.  In addition there was no evidence that the hoist had been
inspected by a
designated or competent person following attempts to weld and repair the
hoist.
One feasible and acceptable abatement method, among others, to correct
this hazard is to comply
with American National Standards Institute (ANSI) B-30.16-1993 which
contains specifications
for the frequent and regular inspections of underhung overhead hoists and
requires that any
adjustments or repairs of hoists be according to manufacturer's
recommendations and
inspected/evaluated by a designated, competent person.
