Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to working conditions and recognized hazards of being overcome by toxic gas and/or oxygen deficient atmospheres and of being seriously burned while cleaning out the ash from inside the incinerator: a) At the incinerator, employees enter the incinerator without following confined space entry procedures. This subjects employees to the hazards of being asphyxiated due to lack of oxygen, being overcome by toxic gas, or being burned by sudden flame flare-ups inside the incinerator. Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish and enforce an adequate confined space entry procedure such a that stipulated by NIOSH criteria document/ publication No. 80-106, December 1979, which includes providing rescue gear, incorporating a permit system, training employees on proper rescue procedures and on routine safety procedures/precautions of oxygen deficient or toxic atmospheres, and other aspects of NIOSH publication No. 80-106. Another feasible method of abatement to correct this hazard is to eliminate the need for employees to enter the confined space by altering incinerator clean out procedures.
