Section 5(a)(1) of the Occupational Safety and Helth Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees, in that employee was exposed to
the hazard of being crushed by a fork lift truck:
On or about September 21, 1992, an employee was prepairing to remove the
drive motor from the Yale Fork Lift Truck (serial number: N331698) that
had been elevated by the Auto Quip Fork Truck Service Lift (serial number:
47832663) when the fork lift truck fell from the lift onto the employee
working beneath the truck. The employee was thereby crushed by the lift
truck. Among other methods, one feasible and acceptable abatement method
to correct this hazard is to implement and enforce the company's existing
participatory job safety analysis (PJSA) and the manufactures safe
operating procedures for the safe use of fork truck service lift.
