Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of asphyxiation and chemical burns: (a) On or about May 26, 1993, an employee making preparation to wash a tank lost conciousness when he was exposed to a cloud of nitrogen and diethylenetrizmine vapors that were suddenly released from a pressurized truck tank. Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish and implement the following training programs and rules: 1. Establish a program to train employees on how the recognize or determined pressurized truck tank. 2. Establish a program to train employees on how to train employees on how to depressurize truck tanks. 3. Establish the following rules and ensure implementation before bring truck trailes into the tank wash room: a. Treat all tanks as if they are pressurized vassels. b. Inspect all vessels to determine pressurization status. c. Depressurize all vessels when needed. d. After vessel has been depressurized, move it to tank wash room and proceed to follow tank washing procedures. 4. Ensure that employees, especially tank washers are effectively trained in the above referenced programs.
