Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employement
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that employees
were exposed to:
a.   The doctors assistants and other office personnel involved
in minor surgery were exposed to the hazard of direct skin
contact with blood and/or other body fluids from the surgery
and had not been provided Hepatitis B vaccinations in the
amounts and at times prescribed by standard medical
practice.  This requirement for vaccination for Hepatitis
B virus is from a Joint Advisory Notice from the Department
of Labor/Department of Health and Human Services (Center
for Disease Control) dated October 19, 1987, and from 29
CFR 1910.1030, OSHA's bloodborne pathogens Standard.
b.   Assistants and employee assisting the doctors in surgery
were exposed to direct contact with blood and other body
fluids, and the employer failed to establish a training
program for these employees.
