Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that employees
were exposed to:
Employees in the packing department during pouring operations
were exposed to excessive ergonomic stress caused by lifting
hazards and repetitive motions associated with the transport
and transfer of candy from trays to the conveyor system.  The
pouring operation caused elbow strains, back strains, wrist
strains, shoulder strains, and other related health effects.
Feasible and acceptable methods of abatement include but are not
limited to the following:
1.   Implement a system of transporting and transfer of the
candy to the conveyor in the packing department that
does not require the repetitive lifting of containers.
2.   Provide basic modifications to the pouring operation
by using a mechanical mechanism to place the candies
onto the packing conveyor system.
3.   Implement Administrative controls that include employee
rotation to jobs without significant ergonomic stresses.
4.   Implement a complete ergonomic program that includes:
A.   Worksite Analysis
B.   Hazard Prevention and Control
C.   Medical Management
D.   Training and Education
Disclaimers:
a.   The employer is not limited to the abatement methods
suggested by OSHA.
b.   The methods explained are general and may not be effective
in all cases.
c.   The employer is responsible for selecting and carrying out
an appropriate abatement methods.
Submit to Area Director in writing a detailed plan of abatement within
30 days, planning a schedule for the implementation of engineering
or administrative measures to control employee exposure to undue
ergonomic stressors.  This plan shall include, at a minimum, dates
for the following actions which must be consistent with dates required
by this citation.
1.   Evaluation of the conditions, locations, and activities
that the employees are performing.
2.   Evaluation of applicable control measure(s).
3.   Procurement, installation, and operation of selected control
measures.
4.   Assure effective utilization of the control measure(s).
Abatement shall have been completed by implementation of feasible
engineering or administrative controls.
