Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of serious injury or death from fires, explosions, and/or toxic vapor releases. (A)Ashland did not assure protection of employes in occupied work areas. In that the "old south control room", was not situated outside of the critical radius of hydrocarbon release from vessels and piping in the area. Although the building was provided with a positive ventilation system, the system was not operational (down for repairs). This could allow for the entrance of flammable hydrocarbon and/or toxic vapors into the building. The building was not afforded protection through explosion-resistant construction or adequate barricading. Among others, one feasible method of abatement to correct this hazard includes, but is not limited to: (1)Follow accepted industry guidelines for plant layout and spacing, including, but not limited to: (a)The Dow Chemical Company "Fire and Explosion Index Hazard Classification Guide. (2)(a)If adequate spacing cannot be achieved, alternative methods of protection must be implemented. The building shall be afforded protection through explosion-resistant construction or adequate barricading. (b) Provide a positive ventilation system which is alarmed and/or monitored to issue a warning to the employees in the event of a failure with the system. (c) Provide a fresh source of filtered air for the employees in the building. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of inhalation of toxic gases and vapors while performing an emergency shutdown in the main control room located in the north area. (B)The employer did not provide an intake ventilation system that met the requirements of National Fire Protection Association Code for Purged and Pressurized Enclosures, NFPA 496 - 1993. NOTE: Among other methods, a feasible and acceptable abatement method to correct this problem is: (a)Provide a backup ventilation system with a manifolded compressed air system that will maintain positive pressure during a hazardous gas or vapor release. (b)Provide detectors in the control room ventilation system to monitor for entry of flammable and hazardous substances such as hydrogen sulfide, naphtha, isobutane. (c)Provide ventilation ducting away from the building to a location where the presence of flammable/hazardous gases will be minimal. (d)Provide SCBA's in sufficient quantity to allow personnel to work in unknown concentration of flammable or toxic gases.
