Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that on
5/3/94, employees were exposed to the hazard of broken bones, internal
injuries and death
from falls of approximatley 16 feet while performing work duties on
metal/wood form walls
including, but not limited to, climbing up the walls and moving about on
top of walls while
installing and securing metal pin form ties.
Methods of abatement may include, but are not limited to, the use of fall
protection systems
such as, scaffolding, catch platforms, guardrails, aerial lifts or
static/catenary lines in
conjunction with safety belts or harnesses and lanyards.

29 CFR 1926.95(a):  Protective equipment was not used when necessary
whenever
hazards
capable of causing injury and impairement were encountered:
At the Medina Water Treatment Plant worksite, the employer did not ensure
that employees
were adequately protected from falls of approximately 16 feet with safety
belts or harnesses
and lanyards while climbing and working on top of metal/wood form walls.
