Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) crushing injuries, fractures, and death from falling and being
struck by refuse
collection vehicles when riding on steps while rear-loading
collection vehicles
were backing or when riding on the loading sill, Natchtwey Road,
Town of
Gibson, Manitowoc County.  These practices are recognized hazards per
American National Standards Institute (ANSI), Z245.1-1975, Safety
Requirements
for Refuse Collection and Compaction Equipment, paragraphs 6.2.4.1
and
6.2.4.2.
Feasible and acceptable methods to correct these hazards are: (1)
Providing instruction and
training in the proper use of mobile equipment before assigning employees
to the collection
vehicle (ANSI Z245.1-1975, paragraph 6.1.1(1)) and (2) Monitoring the
employees' operation
of mobile equipment and taking appropriate action to ensure the proper
use of mobile equipment
and adherence to safety practices (ANSI Z245.1-1975, paragraph 6.1.1(4)).
