Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) At this facility, possibility of severe injury existed when
performing maintenance/repairs on equipment such as rectifiers,
cranes, barrel lines, steam traps. Employees performed these
necessary maintenance/repair duties without employing a positive
means of locking out the main energy source, such as the intent of
protecting workers using the principles of machine lockout/tagout
discussed in ANSI Z244.1-1982.
Abatement of the hazard can be accomplished by the establishment of
management controls over the work being performed, instruction of
workers in the recognition of hazards, and establishing a positive
lockout program. Specific elements of the abatement program shall be
expected to include but not necessarily limited to:
1) Before any maintenance, inspection, cleaning, adjusting or servicing
of equipment (electrical, mechanical, or other) that requires
entrance into or close contact with the machinery or equipment, the
main power disconnect switch or valve, or both, its source of power
or flow of material, shall be locked out or blocked off with padlock,
blank flange, or similar device. Residual energy in equipment having
systems such as pneumatic, hydraulic, compressed springs, or other
shall have these systems bled off, blocked or other effective means
implemented to ensure that all sources of energy have been
deactivated.
2) Locks keyed separately to ensure removal only by the authorized
person shall be provided to each person working in areas requiring a
lockout. Where more than one person is involved in a single operation
or where multiple operations (such as both electrical and mechanical
maintenance) are being simultaneously performed on a single piece of
equipment, locks shall be used by each person.
3) A written lockout policy shall be established, including procedures
for locking out equipment or machinery. Employees involved in
implementing the program shall be trained in all elements thereof.
4) It shall be responsibility of the employer to implement enforcement
guidlines to verify, through periodic inspections, the employees'
compliance with these policies.

employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) Employer had not provided safety training, safety procedures, and
practices for employees required to enter plating tanks, such as the
10 feet deep hard chrome tank, clean them for maintenace. The
procedures include, but not be limited to:
1) Employees must obtain written authorization signed by at least one
supervisor prior to confined space entry.
2) Lockout, blocking or equivalent of all mechanical, electrical, liquid
and gas systems relating to the confined space that may create a
hazard during entry should these systems be put in motion.
3) Test the atmosphere prior to entry into the confined space and on a
regular basis during occupancy for presence of sufficient oxygen and
for absence of hazardous levels of toxic or combustible gases.
4) Establish a tag out system to mark the confined space unsafe for
entry should tests indicate the space is unsafe for entry.
5) Mechanical ventilation of the confined space prior to entry and
continued ventilation during entry to assure safe atmosphere.
6) Written emergency rescue procedures with a requirement that trained
personnel are available and are stationed outside the confined space
with proper equipment to provide for the rescue of persons entering
the space.
7) Confined space entry procedures shall be written and the responsible
employees shall be trained in all aspects of the procedures.
