Section 5(a)(1) of the Occupational Safety and Health Act of 1970:

The employer did not furnish employmnent and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:
On and prior to 7/19/95, employees were exposed to serious injury
while conducting high pressure moleing operations without the use
of an operator controlled "dump system".
Among other methods, the following are feasible and acceptable
methods to minimize the probability of injury.
(1)   Document and enforce the use of a operator controlled "dump
system"; e.g., foot valve.
(2)   Retrain operators on an annual basis, or more frequently if
needed, on the safe operation of high pressure water jetting
equipment.
(3)  Instruct "crew leaders" of their responsibility in enforcing
safe operating procedures during all high pressure water jetting
operations.
(4)  There shall be a pump operator at all times who shall be in
communication between working crew and the attendant.ion
