Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) ANSI B-153.1 1981 Title: Safety Requirements for the Construction, Care, and Use of Automotive Lifts. Section 6-6.1 Maintenace. The owner or employer did not maintain and care for the lift to ensure its continued safe operation. eg) Employees were required to operate and work under a defective/ leaking hydraulic automotive lift (hoist) system, exposing them to potential crush hazards resulting from an accidental drop of the lift system's hydraulic pressure. b) ANSI B-153.1 1981 Title: Safety Requirements for the Construction, Care, and Use of Automotive Lifts. Section 6-6.3 Inspection. The owner or employer did not establish a periodic inspection procedure as recommended by the manufacturer to ensure the safe operation of the lift. eg) A periodic inspection was not conducted on four (4) hydraulic lift (hoist) units, located in the service garage area. Employees working on these units were exposed to potential crush hazard resulting from hydraulic failure.
