Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The

employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) Employees was exposed to material in excess of the ceiling valve
recommended by the manufacturer:
The painter at the paint spray booth was exposed to the hexamethylene
diisocyanate at a 15 minute ceiling level of 0.184 mg/m3, approximately
1.3 times th limit of 0.14 mg/m3; this limit is established to prevent
lung disease, respiratory irritation, respiratory tract and skin
sensitization. The sample was collected on September 16, 1988 during a
15 minute sampling period; exposure calculations include a zero
increment for the 0 minutes not sampled.
General methods of control applicable in these circumstances include,
but are not limited to the following:
1) Prohibiting the painter from applying paint while downstream of the
part being sprayed. This can be done by using a turntable that allows
the part to be turned.
Alternatively, the part could be manually lifted and turned.
2) Chnaging to a paint that contains no hexamethylene diisocyanate.
Abatement Schedule
Step 1 - 11/29/88
Effective respiratory protection shall be provided and used by exposed
employees as an interim protective measure until feasible engineering
and/or administrative controls can be implemented or whenever such
controls fail to redue employee exposure to within permissable exposure
limits.
Step 2 - 12/12/88
Submit to the Area Director a written detailed plan of abatement
outlining a schedule for the implementation of engineering and/or
administrative measures to control employee exposure to hazardous
substances referenced in this citation. The plan shall include, at a
minimum, target dates for the following actions which must be consistent
with the abatement dates required by this citation:
a) Evaluation of engineering/administrative control options;
b) Selection of optimum control methods and completion of design;
c) Procurement, installation and operation of selected control measures;
d) Testing and acceptance of modification/redesign of controls
All proposed control measures shall be approved for each particular
use by a competent Industrial Hygienist or other technically
qualified person. Ninety (90) day progress reports are required
during the abatemetn period. The 90-day requirement for the
submission of progress reports may be shortened or lengthened by the
Area Director depending on the specific circumstances.
Step 3 - 3/17/89
Abatement shall have been completed by the implementation of feasible
feasible engineering and/or administrative controls upon verification
of their effectiveness in achieving compliance.
