Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish a place of employment which is free from
recognized hazards that were likley to cause death or serious physical
harm to employees working inside of whey tanker trailers in that:
a) A confined space entry program was not established to protect
employees who were exposed to atmospheres which are potentially
deficient in oxygen and/or an excess of acceptable person exposure
limits of toxic contaminants.
The American National Standards Institute standard (ANSI Z 117.1 - 1982)
"Safety Requirements for Working in Tanks and Other Confined Spaces",
and the proposed OSHA standard 1910.146 "Confined Space Entry" contain
acceptable methods of compliance which include the following;
1) Training of personnel in confined space entry procedures.
2) Testing of the atmosphere prior to entry.
3) Ventilation of the confined space.
4) Stand-by personnel are to be in direct communication with those
employees (s) within the confined space.
5) Respiratory protection that is appropriate for the atmosphere to
which they are exposed.
6) A permit system authorizing approval for all work and appropriate
protective measures that are to be provided.
7) A monitoring program to insure that the "Confined Space Entry
Program" is being followed by those in the work place.
