Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) The employer did not furnish employees working as welders inside car
bodies and dipper handles located in building 71 a place of
employment which is free from recognized hazards that were causing
or likely to to cause death or serious physical harm in that:
Employees were exposed to atmospheres which are potentially deficient
in oxygen and which were in excess of acceptable personal exposure
limits of iron oxide and manganese without implementing a confined
space entry program.

Requirements for Working in Tanks and Other ConfinedSpaces and OSHA
draft standard 1910.146 "Confined Space Entry" contain acceptable
requirements that include:training personnel; testing the atmosphere
for oxygen deficiency; ventilation of the confined space; stand-by
personnel in constant communication with those inside a confined space;
respiratory protection; permit system authorizing approval for all work
and appropriate protective measures that are to be provided.
