Section 5(a)(1) of the Occupational Safety and Health Act of 1970:    The

employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
(a)  Workers operating material handling equipment at
Navistar International Transportation Corporation, such as,
but not limited to, industrial lift trucks, were exposed to
the hazards created by the sudden and unexpected failure of
critical components of the equipment, which if it should
occur, could result in the loss of the operator's ability to
safety control the equipment.
Abatement of this hazard can be accomplished by
providing, following, and accomplishing a scheduled
preventive maintenance, lubrication, and inspection system
which is prescribed by ANSI B56.1, and which had
previously been in effect at Navistar on a monthly,
quarterly, and semi-annual basis.nnual
