Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about March 22, 1994 employee(s) were exposed to the hazard of falling and/or being struck by the Link Belt LS-5800 Excavator when riding in the excavator bucket to access the 20 foot deep excavation. Among other methods, one feasible and useful method to correct this hazard is to: (1)Establish and enforce a work rule prohibiting employees from riding the attachment bucket as outlined in the Link Belt operators Manual. (2)Provide alternative safe means of entering excavation such as ladders, or
