Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from not being restrained in a forklift in case of tipping and/or roll over. a)Marine Terminal, Barbers Point Harbor: An employee was operating a Hyster forklift, moving concrete covers over the underground conveyor system. The forklift was equipped with a seatbelt, however, the employee did not use the restraint system. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THE HAZARD IS TO WEAR THE SEATBELT AS REFERENCED IN ASME B56.1-2004 "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS."
