Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Hotel wharf, portside M/V AI PU SHUN: Employees were exposed to a 9.5' fall while rigging a scrap metal dumpster for loading into the ships' hatch. One feasible and acceptable abatement method, among others, to correct this hazard is: Develop a comprehensive SOP that fully describes the safety procedures to be followed when rigging a dumpster for loading onboard ship: 1.Remove the dumpster from the truck bed and connect the shackles from the ground level. 2.Use the method employed by Hugo Neu Proler a leader in the scrap metal business. A lifting pan is attached to the crane, trucks unload into the pan, it's then emptied into the hatch onboard ship. This eliminates rigging the lift for every load.
