Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that:
All high risk health care workers (including employees in any occupation
where they are directly exposed to body fluids), shall receive education
on precautionary measures, epidemiology, modes of transmission, and pre-
vention of HBV/HIV. Health care workers shall be counseled regarding
possible risks to the fetus from HBV/HIV and other associated infectious
agents.
Through employee interviews conducted on 3/23/90, and 3/29/90, there
were a substantial number (including but not limited to those listed
above) who had not recieved the required training on bloodborne diseases
Modify the facility's Infection Control Policy to address all employees
at substantial risk of directly contacting body fluids. all such
employees shall be offered hepatitis B vaccinations, free of charge in
amounts and at times prescribed by standard medical practices.
On 3/23/90, it was observed that high risk employees, including but not
limited to, anenvironmental assistant and a housekeeper had not been
offered the hepatis B vaccination.
