employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that:
On 1/24/90, the employer failed to furnish his empoloyees working in
or around a freight elevator located between the 3rd floor storage
area, and the 2nd floor press room area, employment and a place of
employment which was free from recognized hazards that were likely to
cause death or serious physical harm to his employees in that:
(1) The employer required or allowed employees to operate the elevator
without proper safeguards.
(2) The gate door had defective interlocks which will allow the elevator
to operate when it is opened.
(3) Employees were exposed to a potential crush hazard created by two(2)
openings one measuring 1'9" from the top of the elevator's
doorway, to the gate's top edge. The 2nd opening measures 1'5" from
the bottom of the doorway, to the gate's bottom edge.
